The present debate on constitutional rights aims to protect the individual against the intrusive power of the state. Analysing the precarious relationship between art and money, the authors argue that constitutional rights need to be extended into the regimes of private governance. This requires four fundamental changes. (1) Constitutional rights can no longer be limited to the protection of individual actors. Instead, they need to be extended to guarantees of freedom of discourses. (2) The new experience of the twentieth century (...) is that totalizing tendencies have their origin not only in politics, but also in other fields of action, especially in technology, science, and the economy. Thus, a discursive concept of constitutional rights should be directed against any social system with totalizing tendencies. (3) Instead of concentrating on centres of economic and social power, constitutional rights in the private sphere should focus on the specific communicative medium of the expansionist social system involved. (4) This excludes the direct analogy of a ‘right’ as a quasispatial exclusion zone. More significant guarantees of discursive autonomy could be found in a ‘proceduralization’ of constitutional rights. (shrink)

This paper outlines the development and implementation of a new course in Engineering Ethics at the University of Tennessee. This is a three-semester-hour course and is jointly taught by an engineering professor and a philosophy professor. While traditional pedagogical techniques such as case studies, position papers, and classroom discussions are used, additional activities such as developing a code of ethics and student-developed scenarios are employed to encourage critical thinking. Among the topics addressed in the course are engineering as a profession (...) and its role in society; ethical successes and failures; risk, safety, and the environment; professional responsibilities; credit and intellectual property; and international concerns. This article examines the racial politics that reshaped psychoanalytic psychotherapy and ushered in a community mental health paradigm during the U.S. Civil Rights Era. Policymakers in the 1960s adopted the language of social justice to condemn psychoanalysis for its inability to treat psychotics and its unwillingness to treat black patients; yet the community psychiatry model of treatment that replaced it compounded the denial of the black subject’s clinical needs. Challenging the extant historiography that appraises psychoanalysis as a victim of neoliberalism (...) and psychopharmacology, this paper examines how and why Freudian practitioners beat their own retreat from the specter of desegregation. No discussion of when an individual is dead is meaningful in the absence of a definition of death. If human death is defined as the irreversible loss of the capacity for consciousness combined with the irreversible loss of the capacity to breathe spontaneously (and hence to maintain a spontaneous heart beat) the death of the brainstem will be seen to be the necessary and sufficient condition for the death of the individual. Such a definition of death is not something (...) radically new. It is merely the reformulation -- in the language of the neurophysiologist -- of much older concepts such as the 'departure of the (conscious) soul from the body' and the 'loss of the breath of life'. Some 20 years ago Todd and colleagues proposed that rhythm perception is mediated by the conjunction of a sensory representation of the auditory input and a motor representation of the body (Todd, 1994a, 1995 ), and that a sense of motion from sound is mediated by the vestibular system (Todd, 1992a, 1993b ). These ideas were developed into a sensory-motor theory of rhythm and beat induction (Todd et al., 1999 ). A neurological substrate was proposed which might form the (...) biological basis of the theory (Todd et al., 2002 ). The theory was implemented as a computational model and a number of experiments conducted to test it. In the following time there have been several key developments. One is the demonstration that the vestibular system is primal to rhythm perception, and in related work several experiments have provided further evidence that rhythm perception is body dependent. Another is independent advances in imaging, which have revealed the brain areas associated with both vestibular processing and rhythm perception. A third is the finding that vestibular receptors contribute to auditory evoked potentials (Todd et al., 2014a, b ). These behavioral and neurobiological developments demand a theoretical overview which could provide a new synthesis over the domain of rhythm perception. In this paper we suggest four propositions as the basis for such a synthesis. (1) Rhythm perception is a form of vestibular perception; (2) Rhythm perception evokes both external and internal guidance of somatotopic representations; (3) A link from the limbic system to the internal guidance pathway mediates the “dance habit”; (4) The vestibular reward mechanism is innate. The new synthesis provides an explanation for a number of phenomena not often considered by rhythm researchers. We discuss these along with possible computational implementations and alternative models and propose a number of new directions for future research. (shrink)

Materials play an important role in the formation of the lifeworld. In a concentration camp, they often gain an unexpected existential importance. According to the context clothes, wood, food, earth change their meaning for the detainees. The kind of clothes corresponds with the type of camp and may be an indicator for the chances to survive. (...) In a concentration camp, a piece of wood can either be used to heat a room in extreme cold and contribute to the survival of a detainee or to beat and torture a prisoner. Finally, the materiality of food is experienced as a prerequisite of life; its absence is a threat, its availability a hope for survival. (shrink)

Evolutionary scepticism holds that the evolutionary account of the origins of the human cognitive apparatus has sceptical implications for at least some of our beliefs. A common target of evolutionary scepticism is moral realism. Scientific realism, on the other hand, is much less frequently targeted, though the idea that evolutionary theory should make us distrustful of science is by no means absent from the literature. This line of thought has received unduly little attention. I propose to remedy this by advancing (...) what I will call an evolutionary sceptical challenge to scientific realism. I argue that, given standard evolutionary theory, our possession of sound innate metaphysical intuitions would have taken an epistemically problematic ‘lucky accident’. This, as I will show, entails that scientific realism is a self-undermining position. I discuss objections to my argument’s two premises, including ones that appeal to the success of the sciences and to the possibility that sound innate metaphysical intuitions evolved as an evolutionary ‘by-product’. I then draw out an advantage of my argument over a similar one recently put forward by Graber and Golemon. I finish by submitting that scientific realism, given the soundness of my argument, is faced with a new ‘Darwinian Dilemma’, and briefly address the significance of this for the debate between realists and anti-realists in the philosophy of science. From the angles of musicology, psychology, sociology, and science and technology, Over and Over reassesses the complexity connected to notions of repetition in a variety of musical genres. The first edited volume on (...) repetition in 20th- and 21st-century popular music, Over and Over explores the wide-ranging forms and use of repetition - from large repetitive structures to micro repetitions - in relation to both specific and large-scale issues and contexts. The book brings together a selection of original texts by leading authors in a field that is, as yet, little explored. Christopher Nolan’s seems a spy thriller in which a government operative saves the world. As others have noted, it is in a larger sense about climate change—even though it mentions it but once. Where the film has been dismissed as not saying anything substantial, or even read as promoting an activist message, I argue it is most coherently interpreted as a reactionary defense of the status quo. The film is about a war between the present and future, its heroes those (...) who beat back time travelers trying to prevent us from destroying the planet. If audiences are not passive recipients of propaganda, but critical and cognitive, then blockbusters need to distract them from unavowable larger meanings by redirecting interpretive energies into the details; plot holes are not a bug, but a feature. The meticulous, puzzle-box construction of Nolan’s films, which encourages elaborate fan theorizing, distracts both viewers and Nolan himself from their ideological content. (shrink)

Heuristics make decisions not only fast and frugally, but often nearly as well as “full” rationality or even better. Using such heuristics should therefore meet health care standards under liability law. But an independent court often has little chance to verify the necessary information. And judgments based on heuristics might appear to have little legitimacy, given the widespread belief in formal rationality.

Science is a social epistemic enterprise. The complexity of research requires the division of cognitive labor. As a consequence, scientists have to present results and incorporate the results of others into their body of knowledge. This creates the possibility of strategic behavior, leading to phenomena such as publication bias. To analyze the dynamics of strategic behavior in epistemic communities, agent-based modeling suggests itself as a method. The phenomena generated by the developed agent-based simulation model reveal a diverse set of possible (...) dynamics in strategically heterogeneous groups and support the claim that there is a trade-off between a behavioral rule’s efficacy to generate accurate beliefs under optimal conditions and its robustness to variation in the composition of the epistemic environment. This article outlines an epistemological perspective to understand the organism as a temporally changing whole. To analyze the mental faculties involved, the organism’s development and persisting existence is differentiated into four interdependent aspects: descent, future existence, persistent species, and environmentally adapted physical appearance. It is outlined that these aspects are recognized by comparative memory, concept-guided anticipation, conceptual thinking, and sensory perception, respectively. Furthermore, it is pointed out that these aspects correspond to the famous four Aristotelian “causes” or principles of explanation. (...) The descent of an organism corresponds to Aristotle’s efficient principle (“where does it come from?”), its future existence to the final principle (“what is if for?”), its physical structure to the material principle (“out of what is it?”) and its persistent species to the formal principle (“what is it?”). Aristotle regarded the unity of the efficient, formal and final principle as the ontological cause of the organism and called it the “soul” (psyche), while the material principle can be understood to represent its “body” (soma). I suggest that Aristotle’s “soul” corresponds to three of the four mental faculties required for cognition of a self-maintaining organism. I argue that in a Kantian perspective, the Aristotelian “soul” represents the condition for recognizing an organism at all. Therefore, the Aristotelian principle of life becomes intelligible and even empirically observable through the inner sense. In summary, I suggest that the four aspects of the organism described here can be viewed as the general, epistemological and ontological principle of the organism, the Bio-Logos. (shrink)

ArgumentThis essay places some therapeutic vaccines, including particularly the diphtheria antitoxin, into their larger historical context of the late nineteenth century. As industrially produced drugs, these vaccines ought to be seen in connection with the structural changes in medicine and pharmacology at the time. Given the spread of industrial culture and technology into the field of medicine and pharmacology, therapeutic vaccines can be understood as boundary objects that required and facilitated communication between industrialists, medical researchers, public health officials, and clinicians. (...) It was in particular in relation to evaluation and testing for efficacy in animal models that these medicines became a model for twentieth-century medicine. In addition, these medicines came into being as a parallel invention in two very distinct local cultures of research: the Institut Pasteur in Paris and the Institut für Infektionskrankheiten in Berlin. While their local cultural origins were plainly visible, the medicines played an important role in the alignment of the methods and objects that took place in bacteriology research in France and Germany in the 1890s. This article assesses the two locally specific regimes for control in France and in Imperial Germany. In France the Institut Pasteur, building on earlier successful vaccines, enjoyed freedom from scrutinizing control. The tight and elaborate system of control that evolved in Imperial Germany is portrayed as being reliant on experiences that were drawn from the dramatic events that surrounded the launching of a first example of so-called “bacteriological medicine,” tuberculin, in 1890. Promotion of pro-social attitudes and moral behaviour is a crucial and challenging task for social orders. As traditional ways such as moral education have some, but apparently and unfortunately only limited effect, some authors have suggested employing biomedical means such as pharmaceuticals or electrical stimulation of the brain to alter individual psychologies in a more direct way — moral bioenhancement. One of the salient questions in the nascent ethical debate concerns the impact of such interventions on human freedom. Advocates argue (...) that moral bioenhancements do not pose a serious threat to freedom. This contention, however, is based on an overly narrow, if not impoverished, sense of freedom, which comprises only freedom of action and freedom of will. Mind-altering interventions primarily affect another sense of freedom: freedom of mind, a concept that has not received much attention although it should rank among the most important legal and political freedoms. The article introduces three senses of mental freedom potentially infringed upon by moral bioenhancement and places it in a broader perspective. Ignorance of mental freedom has far-ranging consequences for the shape of the political and legal order at large. As many advocates are apparently not aware of the freedoms they seek to undermine, their calls for moral enhancement programmes are dangerously premature. (shrink)

The article presents the most important systematic philosophical questions and problems regarding altruism, outlines various answers to these, discusses them, develops precise definitions of ‘altruism’ / ‘altruistic’, 'self-interested', 'egoistic', etc. and develops a normative theory of altruism. The starting point is an assumption about the ethical function of the normative concept of altruism, namely that it captures an ideal: acting for the benefit of others beyond one's moral duty. On this basis, the normative concept of altruism is defined. This is (...) followed by an overview of the ethics that explicitly or implicitly advocate altruism. The subsequent discussion of psychological altruism centres on the question of whether and, if so, which human motives may be intrinsically aimed at the good of others. The most important such motive is acting out of empathy. The final section addresses whether and how altruistic action can be rational. (shrink)

Throughout its age-old tradition, philosophy has continuously been presented with new challenges. The latest one in this series comes from the experimental disciplines and their methodology: experimental philosophy has, during the last 10 to 15 years, increasingly gained reputation, and it has certainly been a controversial issue. Within this movement, the field of ethics deserves more attention. This article aims to give not a complete overview of, but at least an introduction to, the newly rising field of ‘Experimental Ethics’, the (...) chances it offers, the problems for discussion, and the criticism to be expected. In this paper, I aim to develop a novel virtue reliabilist account of justified belief, which incorporates insights from both process reliabilism and extant versions of virtue reliabilism. Like extant virtue reliabilist accounts of justi- fied belief, the proposed view takes it that justified belief is a kind of competent performance and that competent performances require reliable agent abilities. However, unlike extant versions of virtue reliabilism, the view takes abilities to essentially involve reliable processes. In this way, the proposed takes (...) a leaf from process reliabilism. Finally, I will provide reason to believe that the view compares favourably with both extant versions of virtue reliabilism and process reliabilism. In particular, I will show that in taking abilities to essentially involve reliable processes, the view has an edge over extant versions of virtue reliabilism. Moreover, I will argue that the proposed view can either solve or defuse a number of classical problems of process reliabilism, including the new evil demon problem, the problem of clairvoyant cases and the generality problem. David Velleman’s discussion of the character of Milton’s Satan is mentioned to illustrate the Special Issue’s (...) main question of whether instantiations of individual and collective agency are conceivable that deliberately act for the sake of the bad. According to recent social interactionist accounts in developmental psychology, a child's learning to talk about the past with others plays a key role in memory development. Most accounts of this kind are centered on the theoretical notion of autobiographical memory and assume that socio-communicative interaction with others is important, in particular, in explaining the emergence of memories that have a particular type of connection to the self. Most of these accounts also construe autobiographical memory as a species of episodic memory, (...) but its episodic character, as such, is not typically seen as falling within the remit of an explanation in social interactionist terms. I explore the idea that socio-communicative interaction centered on talk about the past might also have an important role to play, quite independently of considerations about the involvement of the self in memory, in accounting for the emergence of memories that are episodic in character, i.e., memories that involve the recollection of particular past events. In doing so, I also try to shed light on a distinctive role that talk about the past plays in socio-communicative interaction. (shrink)

Recent knowledge first epistemology features a number of different accounts of justified belief, including a knowledge first reductionism according to which to believe justifiably is to know Sutton, Littlejohn, Williamson, a knowledge first version of accessibilism Millar and a knowledge first version of mentalism Bird. This paper offers a knowledge first version of virtue epistemology and argues that it is preferable to its knowledge first epistemological rivals: only knowledge first virtue epistemology manages to steer clear of a number of problems (...) that its competition encounters.
